In the Christian West the brotherhoods arose from the sec xiii; but in Italy the first Associations of the workers who had been organizing since the early years of the Aragonese era under the protection of the individual Religious (Chaplains) or Ecclesiastical bodies for mutual assistance purposes, for the exercise of Worship and the Salvation of the soul, spread in the SEC. XIV, especially at the end of the SEC. XV, when the Franciscans Cherubino da Spoleto and Bernardino da Feltre made themselves zealous propagators, insisting in particular on the practice of accompanying the SS. Viaticum when it was brought to the sick.

The Brotherhoods dedicated themselves to different devotional cults, but all committed to being a school of brotherly love, indivisible from love for God, therefore not only of association solidarity but also communion of prayers and good works in life and death.

At the bottom of their Religious experience was the desire for an integral Christian life, the rediscovery of the Gospel text and the Imitation of Christ Crucified.

From the point of view of social composition they usually involved people especially of the small and middle artisan bourgeoisie, merchant and rural, but there were no shortage of Brotherhoods characterized by a certain aristocratic closure or open to the most affluent classes, to the ruling and Noble classes.

The mutual relations of the Confreres were of material and Spiritual Mutual Aid, especially in cases of illness or death.

The Spiritual and Material Assistant in Disease and the suffrage in death is on the whole not only the most important aspect in the life of most Brotherhoods, but also the most common, most persistent in the life? five centuries and the oldest origins.

Often the Brotherhood also took care of widows and orphans, if they were in situations of poverty and even prepared skills for orphans.

A decisive role in the life of the Brotherhood was played by the statute, which each Confrere obliged to observe.

The members of the Brotherhoods heard their Statutes read many times aloud and easily learned them by heart.

These texts formed them to the true Christian life and left in their souls deeper traces of the same monthly sermons and devout literature.

The Brotherhoods were given by the Council of Trent (1545 – 1563) by the “quaecumque” constitution of Clement VIII of 07 December 1604 and the Code of Canon Law of 1917.

If at the Second Vatican Council the Brotherhoods did not have an Explicit recognition with the traditional denomination and legislation, this does not mean that they have lost their pastoral importance, their ecclesial role and their social and legal importance.no must impress the comparison between the old and the new code, where the Brotherhoods as an Autonomous Institute do not appear, while in the previous one they constituted an Institution in its own right, disciplined

In the new code, however, there is only the general legislation “De Christifidelum Consociationibus” under Title V of the second book “De Populo Dei”.

Like Vatican II, the new code also uses the term “ConsociatiS” in place of “Associatio” hence the notion of the “Consociatio fidelium” which, differentiating itself from the institutes or associations of consecrated life in the predominantly lay field, despite having connatural ends to the life and mission of the church, of which the same is part.

There is no doubt that the Brotherhoods have always qualified themselves from purely ecclesial ends and that they have institutionally pursued the same ends of the Church.

and because they are characterized primarily by the exercise of public worship, they were always erected by ecclesiastical authority.

In Syracuse, in fact, since the Synod of 1727 of Bishop Tommaso Marino, who imposed on the parish priests of your Diocese of Caltagirone the erection of the Brotherhood of the SS. Sacramento, located in the basilical parish of San Giacomo “within two months of its publication”, while in Caltagirone two Diocesan Synods regulate the entire matter: that of Bishop Saverio Gerbino under Title XXV “De Confraternitatibus piisqua sodalitius” and that of Bishop Giovanni Bargiggia in Title III, ch. 2 ” De Confraternitatibus”.

According to Italian law, however, they were governed by the crisky laws of 1890, by the concordat of 1929 and lately also by the agreements agreed in 1984 and by the judgments No. 396 of 1988 and No. 466 of 1990 by the Constitutional Court that recognized “the legal personality of private law, to be implemented either by judicial or administrative means, as public institutions of assistance and charity of a Regional and Interregional character”.
